This document (as well as any other documents referred to herein) sets out the terms and conditions governing the use of this Website (thelordsgummies.com) and the purchase or acquisition of products and/or services through it (hereinafter, the “Terms and Conditions”).
For the purposes of these Terms and Conditions, it is understood that the activity carried out by The Lords through the Website includes:
Through the The Lords website, confectionery products are marketed, mainly high-quality gummies and sweets, under its own brand. The products are offered in different formats, flavours and ranges, including both sweet and sour profiles, and are aimed at both end consumers and professional customers.
In addition to reading these Terms and Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Terms of Use, including the cookie policy and The Lords’ privacy and data protection policy. By using this Website or by placing and/or requesting the purchase of a product and/or service through it, the User agrees to be bound by these Terms and Conditions and by all of the above. Therefore, if the User does not agree with all of the above, they should not use this Website.
Users are also informed that these Terms and Conditions may be amended. The User is responsible for reviewing them each time they access, browse and/or use the Website, as the Terms and Conditions in force at the time the purchase of products and/or services is requested will apply.
For any questions the User may have in relation to these Terms and Conditions, they may contact the owner using the contact details provided above or, where applicable, using the contact form.
2. THE USER
Access to, browsing and use of the Website confers the status of user (hereinafter, referred to interchangeably as “User” individually or “Users” collectively). Accordingly, from the moment browsing begins on the Website, the User accepts all the Terms and Conditions set out herein, as well as any subsequent amendments, without prejudice to the application of the relevant mandatory legal provisions as applicable in each case.
The User assumes responsibility for the proper use of the Website. This responsibility extends to:

The User declares that they are over 18 years of age and have legal capacity to enter into contracts through this Website.
The User may formalise, at their choice, the contract for the sale of the desired products and/or services with The Lords in any of the languages in which these Terms and Conditions are available on this Website.
3. PURCHASE OR ACQUISITION PROCESS
Users may purchase on the Website using the methods and procedures established. They must follow the online purchase and/or acquisition procedure on thelordsgummies.com, during which various products and/or services may be selected and added to the basket, shopping cart or final purchase area and, lastly, click on: “Buy now”.
The User must then complete and/or verify the information requested at each step, although during the purchase process, and before making payment, the purchase details may be modified.
The User will subsequently receive an email confirming that The Lords has received their order or purchase request and/or service request, i.e., the order confirmation. Where applicable, the User will also be informed by email when their purchase is being dispatched. Where appropriate, this information may also be made available to the User via their personal account area on the Website.
Once the purchase procedure has been completed, the User agrees that the Website will generate an electronic invoice, which will be sent to the User by email and, where applicable, via their personal account area on the Website. The User may also, if they so wish, obtain a paper copy of their invoice by requesting it from The Lords using the contact options on the Website or the contact details provided above.
The User acknowledges that, at the time of purchase, they are aware of certain specific terms of sale relating to the product and/or service in question, which are shown alongside the product presentation or, where applicable, its image on its page of the Website, indicating by way of example (but not limited to), depending on each case: name, price, components, weight, quantity, colour, product details or features, how the services will be provided and/or the cost of the services. The User acknowledges that placing the purchase order or acquisition constitutes full and complete acceptance of the specific terms of sale applicable in each case.
Communications, purchase orders and payments involved in transactions carried out on the Website may be archived and stored in The Lords’ computerised records for the purpose of serving as evidence of the transactions, in all cases respecting reasonable security measures and the applicable laws and regulations, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights, and the rights available to Users under the privacy policy of this Website.
4. AVAILABILITY
All purchase orders received by The Lords through the Website are subject to product availability and/or to no circumstances or force majeure events (clause nine of these Terms and Conditions) affecting the supply of the products and/or the provision of the services. If difficulties arise in the supply of products or if products are out of stock, The Lords undertakes to contact the User and refund any amount that may have been paid. This shall also apply where the provision of a service becomes impossible.
5. PRICES AND PAYMENT
The prices displayed on the Website are the final prices, in Euros (€), and include taxes, unless otherwise stated and applied due to legal requirements, especially in relation to VAT.
Shipping costs are included in the final prices of the products as shown on the Website. Accordingly, The Lords provides delivery and/or shipping services through: Mail Boxes Etcetera.
Under no circumstances will the Website add additional costs to the price of a product or service automatically; only those costs that the User has selected and chosen voluntarily and freely will be added.
Prices may change at any time; however, any changes will not affect orders or purchases for which the User has already received an order confirmation.
Accepted payment methods are: credit or debit card.
The Lords uses all means to ensure the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.
Credit card payments are subject to checks and authorisation by the issuing bank. If the issuing bank does not authorise payment, The Lords shall not be liable for any delay or failure to deliver and will not be able to enter into any contract with the User.
Once The Lords receives the User’s purchase order through the Website, a pre-authorisation will be made on the relevant card to ensure that sufficient funds are available to complete the transaction. The card will be charged at the time the User is sent the dispatch confirmation and/or confirmation of the service being provided, in the manner and, where applicable, place established.
In any event, by clicking “Buy now”, the User confirms that the payment method used belongs to them.
6. DELIVERY
Where physical delivery of the contracted goods is required, deliveries will be made within the following territory: Spain (Mainland, Balearic Islands, Canary Islands, Ceuta and Melilla), European Union, Rest of Europe.
Except in cases where unforeseen or extraordinary circumstances exist, or where applicable due to the customisation of products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User and, in any event, within a maximum period of 30 calendar days from the date of order confirmation.
If, for any reason attributable to it, The Lords is unable to meet the delivery date, it will contact the User to inform them of this circumstance and the User may choose to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.
If it proves impossible to deliver the order due to the User’s absence, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to arrange a re-delivery.
If the User is not going to be at the delivery address during the agreed time slot, they must contact The Lords to arrange delivery on another day.
If 30 days pass from the date the order is available for delivery and it has not been delivered for reasons not attributable to The Lords, The Lords will understand that the User wishes to withdraw from the contract and the contract will be deemed terminated. As a result, all payments received from the User will be refunded, except for any additional costs resulting from the User’s choice of a delivery method other than the least expensive standard delivery method offered by the Website, without undue delay and, in any event, within a maximum period of 14 calendar days from the date the contract is deemed terminated.
However, the User should bear in mind that the transport resulting from termination may entail an additional cost, which may be passed on to them.
For the purposes of these Terms and Conditions, delivery will be deemed to have taken place or the order will be deemed delivered at the moment the User or a third party indicated by the User acquires material possession of the products, which will be evidenced by signature of receipt of the order at the agreed delivery address.
The risks arising from the products will be borne by the User from the moment of delivery. The User acquires ownership of the products when The Lords receives full payment of all amounts due in relation to the purchase or acquisition, including shipping costs, or at the moment of delivery if this takes place after The Lords has received full payment.
In accordance with the provisions of Law 37/1992 of 28 December on Value Added Tax (VAT), purchase orders for delivery and/or provision shall be deemed to be located within the Spanish VAT territory if the delivery address is in Spanish territory, excluding the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the legally valid rate at any given time depending on the specific item in question.
Similarly, in accordance with Chapter I of Title V of Council Directive 2006/112 of 28 November 2006 on the common system of VAT, purchase orders will be located, for delivery and/or provision, in the Member State of the European Union in which the address stated in the purchase order is located, and therefore the VAT applicable will be the rate in force in that Member State.
For orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT in accordance with the provisions of Law 37/1992 and Directive 2006/112, without prejudice to the application of the corresponding taxes and duties under the regulations in force in each of these territories. The User should bear in mind that in these territories there may be situations where taxes and customs duties are applied and become payable at destination, in accordance with the regulations in force, and these may be payable by the User.
For other destinations, different from those above, the regulations in force at any given time will apply for determining where purchase orders are located for delivery and/or provision. The User should bear in mind that this may result in taxes and customs duties being applied and becoming payable at destination, in accordance with the regulations in force there, and these may be payable by the User. 7. TECHNICAL MEANS TO CORRECT ERRORS
The User is informed that, if they detect an error when entering the data necessary to process their purchase request on the Website, they may amend it by contacting The Lords via the contact options enabled on the Website and, where applicable, those enabled to contact customer services, and/or using the contact details provided in clause one (General Information). Likewise, this information may also be corrected by the User through their personal account area on the Website.
In any event, before clicking “Buy now”, the User has access to the area, cart or basket where their purchase requests are recorded and can make amendments.
Similarly, the User is referred to the Legal Notice and General Terms of Use, and specifically the Privacy Policy, for further information on how to exercise their right of rectification under Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 of 5 December.
8. RETURNS
Where the User acquires products on or through the Website of the owner, they have a series of rights, as listed and described below:
Right of Withdrawal
As a consumer and user, the User makes a purchase on the Website and therefore has the right to withdraw from the purchase within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days after the day on which the User, or a third party authorised by the User other than the carrier, acquires physical possession of the goods purchased on The Lords’ Website. If the goods that make up the order are delivered separately, the period will expire 14 calendar days after the day on which the User, or an authorised third party other than the carrier, acquires physical possession of the last of those goods forming part of the same purchase order; or, in the case of a service contract, 14 calendar days from the day the contract is concluded.
To exercise the right of withdrawal, the User must notify The Lords of their decision. They may do so, where applicable, via the contact options provided on the Website.
Regardless of the means chosen to communicate their decision, the User must clearly and unequivocally state that it is their intention to withdraw from the purchase contract. In any case, the User may use the model withdrawal form provided by The Lords as an annex to these Terms and Conditions; however, its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication clearly expressing the decision to withdraw to be sent before the relevant period expires.
In the event of withdrawal, The Lords will refund the User all payments received, including shipping costs (except for any additional costs chosen by the User for a delivery method other than the least expensive standard delivery offered on the Website) without undue delay and, in any event, no later than 14 calendar days from the date on which The Lords is informed of the User’s decision to withdraw.
The Lords will refund the User using the same payment method used by the User for the initial purchase transaction. This refund will not incur any additional costs for the User. However, The Lords may withhold the refund until it has received the returned products or until the User provides evidence of having returned them, whichever occurs first.

The User must do so without undue delay and, in any event, no later than 14 calendar days from the date on which The Lords was informed of the decision to withdraw.
The User acknowledges that they must bear the direct cost of returning the goods (transport, delivery), if any. In addition, the User will be liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The User acknowledges that there are exceptions to the right of withdrawal, as set out in Article 103 of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. By way of example (non-exhaustive), this includes: personalised products; products that may deteriorate or expire rapidly; unsealed music or video CDs/DVDs as sealed at the factory; products which are sealed for health or hygiene reasons and have been unsealed after delivery; supply of digital content not supplied on a tangible medium.
The same applies to any service the User may contract through this Website, as the same law establishes that the right of withdrawal will not apply where the service has been fully performed, or where performance has begun with the consumer’s and user’s express consent and their acknowledgement that, once the contract has been fully performed by The Lords, they will have lost their right of withdrawal.
In any case, no refund will be issued if the product has been used beyond merely opening it, if products are not in the same condition as when delivered, or if they have been damaged after delivery.
Likewise, products must be returned using or including all original packaging, instructions and any other documents accompanying them, together with a copy of the purchase invoice.

Return of defective products or shipping error
This covers all cases where the User considers that, at the time of delivery, the product does not comply with what was agreed in the contract or purchase order and therefore must contact The Lords immediately and inform them of the non-compliance (defect/error) using the same means or the contact details provided in the previous section (Right of Withdrawal).
The User will then be informed how to proceed with returning the products. Once returned, the products will be examined and the User will be informed, within a reasonable period, whether a refund or, where applicable, replacement is appropriate.
The refund or replacement will be carried out as soon as possible and, in any event, within 14 days following the date on which we send the User an email confirming that a refund or replacement of the non-compliant item is applicable.
The amount paid for products returned due to a defect (where one genuinely exists) will be refunded in full, including delivery costs and any costs the User may have incurred in returning the goods. The refund will be made using the same payment method used by the User to pay for the purchase.
In any event, the rights recognised in the legislation in force at any given time for the User as a consumer and user shall always apply.
Guarantees
As a consumer and user, the User benefits from statutory guarantees on products purchased through this Website, under the legally established terms for each type of product. The Lords is therefore liable for any lack of conformity that becomes apparent within a period of three years from delivery of the product.
In this regard, products are deemed to be in conformity with the contract provided that: they match the description given by The Lords and possess the qualities presented; they are fit for the purposes for which products of the same type are normally used; and they have the quality and performance typical of a product of the same type and which are reasonably expected. Where this is not the case in relation to products delivered to the User, the User must proceed as indicated in the section Return of defective products or shipping error. However, some products marketed on the Website may have non-uniform characteristics, provided these derive from the type of material used in their manufacture and therefore form part of the product’s individual appearance and do not constitute a defect.
Additionally, it may be the case that the User purchases a product on the Website that is branded or manufactured by a third party. In such cases, if the User considers the product to be defective, they may also contact the brand or manufacturer responsible for the product to find out how to exercise their statutory guarantee rights directly against them during the three years following delivery. To do so, the User must have retained all information relating to the product guarantee.

9. LIMITATION OF LIABILITY
Unless otherwise provided by law, The Lords shall not accept any liability for the following losses, regardless of their origin:

Any losses not attributable to any breach on its part.

Business losses (including loss of profit, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditure).

Any other indirect losses that were not reasonably foreseeable by both parties at the time the sales contract for the products was concluded.
Likewise, The Lords also limits its liability in the following cases:

The Lords applies all measures to provide a faithful representation of the product on the Website; however, it is not liable for minor differences or inaccuracies that may exist due to screen resolution, browser issues or other similar reasons.

The Lords will act with maximum diligence in making the product subject to the purchase order available to the transport company. However, it is not liable for damages arising from transport malfunction, especially due to strikes, roadblocks, and generally any other issues typical of the sector, which result in delays, loss or theft of the product.

Technical failures which, due to fortuitous events or other reasons, prevent the normal operation of the service over the internet. Unavailability of the Website for maintenance or other reasons that prevents the service from being provided. The Lords uses all means at its disposal to carry out the purchase, payment and dispatch/delivery process, but is exempt from liability for causes not attributable to it, fortuitous events or force majeure.

The Lords shall not be liable for misuse and/or wear and tear of products used by the User. Likewise, The Lords shall not be liable for an incorrect return made by the User. It is the User’s responsibility to return the correct product.

In general, The Lords shall not be liable for any failure or delay in performing any of its obligations where such failure or delay is due to events outside its reasonable control, i.e., force majeure, which may include, by way of example (non-exhaustive):

Strikes, lockouts or other industrial action.

Civil unrest, riots, invasion, terrorist threat or attack, war (declared or undeclared) or threat or preparation for war.

Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.

Impossibility of using trains, ships, aircraft, motor transport or other means of transport, whether public or private.

Impossibility of using public or private telecommunications systems.

Acts, decrees, legislation, regulations or restrictions of any government or public authority.
In such cases, obligations will be suspended for the duration of the force majeure event, and The Lords will be granted an extension of time to fulfil them equal to the duration of the force majeure event. The Lords will use all reasonable means to find a solution that enables it to fulfil its obligations despite the force majeure event.
10. WRITTEN COMMUNICATIONS AND NOTICES
By using this Website, the User agrees that most communications with The Lords will be electronic (email or notices posted on the Website).
For contractual purposes, the User consents to using this electronic means of communication and acknowledges that any contracts, notices, information and other communications sent electronically by The Lords meet the legal requirements of being in writing. This condition does not affect the User’s statutory rights.
The User may send notices and/or communicate with The Lords using the contact details provided in these Terms and Conditions and, where applicable, via the contact options on the Website.
Likewise, unless otherwise stipulated, The Lords may contact and/or notify the User by email or postal address provided.
11. WAIVER
No waiver by The Lords of any specific right or legal action, or failure by The Lords to require strict performance by the User of any of their obligations, shall constitute a waiver of any other rights or actions arising from a contract or these Terms and Conditions, nor shall it release the User from compliance with their obligations.
No waiver by The Lords of any of these Terms and Conditions or of any rights or actions arising from a contract shall be effective unless it is expressly stated to be a waiver, formalised and communicated to the User in writing.
12. SEVERABILITY
If any of these Terms and Conditions are declared null and void by a final decision issued by a competent authority, the remaining clauses shall remain in force and shall not be affected by such declaration of nullity.
13. ENTIRE AGREEMENT
These Terms and Conditions and any document expressly referred to herein constitute the entire agreement between the User and The Lords in relation to the subject matter of sale and supersede any prior arrangement, agreement or promise made verbally or in writing between the same parties.
The User and The Lords acknowledge that they have entered into the contract without relying on any statement or promise made by the other party, except as expressly set out in these Terms and Conditions.
14. DATA PROTECTION
Any personal information or data provided by the User to The Lords during a transaction on the Website will be processed in accordance with the Privacy Policy or data protection policy (contained, where applicable, in the Legal Notice and General Terms of Use). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all information or data provided is truthful.
15. APPLICABLE LAW AND JURISDICTION
Access to, browsing and/or use of this Website and contracts for the purchase of products through it shall be governed by Spanish law.
Any dispute, issue or disagreement arising from or related to access to, browsing and/or use of the Website, or to the interpretation and enforcement of these Terms and Conditions, or to sales contracts between The Lords and the User, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.
16. COMPLAINTS AND CLAIMS
The User may send to The Lords any complaints, claims or other comments they wish to make using the contact details provided at the beginning of these Terms and Conditions (General Information).
In addition, The Lords has official complaint forms available to consumers and users, which they may request from The Lords at any time using the contact details provided at the beginning of these Terms and Conditions (General Information).
Likewise, if a dispute arises from the conclusion of this purchase contract between The Lords and the User, the User, as a consumer, may request an out-of-court dispute resolution in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
